Article 1 - OBJECT
1.1. Object
The levéloservice is a self-service electric bicycle system offered by the Aix-Marseille Provence Metropolis and whose operation and management are entrusted to the company CITYBIKE GLOBAL through its subsidiary CITYBIKE MÉDITERRANÉE.

Customer Service can be reached every day by mail, email and telephone: Monday to Saturday from 8am to 8pm and Sunday from 9am to 5pm.
Article 2 - DEFINITIONS
Application: refers to the program that can be downloaded free of charge and executable from the operating system (iOS or Android) of a smartphone or tablet. They allow any user of the service to find a nearby station but also to choose a route suitable for cyclists, consult the number of km traveled, subscribe to the service, contact customer service and report an incident.
Community battery : refers to the battery integrated into the bicycle
Bollard: street furniture of the station on which the bikes hang
Account: refers to the customer account created by the user on the applicationor on the Internet andallowing him to access the service.
GCUS : General Conditions of Use of the Service
Duration of continuous use authorized: means a maximum duration of 12 hours of use of the bicycle whose passagewill give rise to the application of penalties by the operator
Parties : refers together to the operator and the user
Operator: refers to the company CITYBIKE M É DITERRANÉE which operates the service on behalf of the Metropolis.
Scan: read the QR code on the bike with its camera in the application
Service: refers to the self-service electric bicycle service offered by the operator
Website: refers to the website https://levelo.ampmetropole.fr made available to Usersand prospects wishing to have information on the service, create their account, subscribe to the service, contact customer service, download the application or consult the GCUS
Station: bicycle parking area, equipped with one or more charging stations and bicycle parking, a maintenance rack and a totem, equipped with a bank terminal or not
Virtual station : parking area for bicycles not equipped with charging stations
Price: price applicable to the service which is expressly communicated via the applicationand/or the internet at the time of validation of the corresponding order
RFID ticket : physical support issued in the CB totems allowing to rent a bike in Passant the ticket on the frame of the bike, at the place indicated by an adhesive
Totem CB: street furniture of the station consisting of an LCD screen, a payment terminal and an RFID ticket printer . It allows any user of the service to buy a short-term subscription using his credit card with the issuance of an RFID ticket, to view the map of the stations and to have access to customer service information.
User : refers to any natural person over 14 years of age with the capacity to use the service
Bicycle: refers to the electrically assisted bicycles used as part of the proposed service The operator
Article 3 - DESCRIPTION DU SERVICE
3.1. Service Presentation
The service allows the user, after creating an account on the application or on the website, to borrow a bike located on a station according to the terms described below.
The service consists of stations. Each station is composed of:
- One or more charging and parking stations, allowing the rental and return of bicycles
- A totem of information of the service, equipped or not with a payment terminal allowing to buy a Pass 24h using his credit card with issuance of an RFID ticket, to view the map of the stations and to have access to the information of the customer service.
- A maintenance hoop, allowing the return of defective bikes
The service is also equipped with an application allowing the user:
- to identify themselves and access the information on their account;
- link their RFID transport card to their account
- to consult the status of stations and the position of bicycles located nearby;
- obtain information relating to the service;
- contact customer service;
- rent a bicycle;
- save, modify or delete their banking information;
- to consult the history of his journeys and payments;
- to consult the GCUS
3.2. Presentation of Subscriptions and 24h Pass
Subscriptions and Passes are strictly personal and attached exclusively to the person indicated as a user when subscribing.
The subscriptions offered as part of the service are as follows:

Subscriptions are taken out on the application and the website.
The Pass offered as part of the service is as follows:

The subscription of the Pass is made on the totem CB, the application and the website.
3.3. Availability of the service
As soon as the user has a valid subscription or Pass, he can rent a bike for an unlimited number of rentals during its validity period.
The service is accessible within the limit of bicycles available on the territory, 7 days a week, 24 hours a day, without interruption, except in cases of force majeure within the meaning of Article 1218 of the Civil Code or decision of an administrative or judicial authority imposing a total or partial, temporary or definitive restriction of the establishment of a station, the use of one or more bicycles or bicycle traffic on the territory where the service is located. The operator makes its best efforts to inform the user in real time of the conditions of availability of the service via the website or application.
For any rental of a minimum duration of 3 minutes, and in order to avoid any privatization of a Bike, a waiting time of 5 minutes is to be respected between two rentals of the same Bike.
Each rental may not exceed the Authorized Continuous Use Period of 12 hours. In the event of a dispute over the duration of use of the service by the user, the data provided by the computer server of the customer service shall prevail. Beyond the Authorized Continuous Use Period, the wish is considered not returned and the operator reserves the right to levy a financial penalty on the user's bank account, for non-return of the bicycle whose amount is defined in Article 9.
Article 4 - MODALITIES OF ACCESS TO THE SERVICE
4.1. Subscription to the service
4.1.1. Via the app or website
In order to subscribe and use the service, the user must create an account on the application or on the website.
The user:
- Defines his identifier (email address) that allows him to connect later to his account information. A 4-digit secret code will be sent to his email address to validate the registration and to access the account;
- provides their personal contact information;
- records the details of a personal and valid credit card;
- accepts these Terms;
- adds proof if applicable;
The user can subscribe from his account to a subscription adapted to his intensity of use.
The user is limited to one account per natural person. Creating an account is free. The operator reserves the right to require the communication of supporting documents such as a copy of the identity card in order to validate the creation of the account.
The user is solely responsible for choosing his identifiers with regard to the rights of third parties, in particular with regard to identity theft or intellectual property rights, as well as for maintaining their confidentiality. In case of loss or forgetfulness of identifiers, the user must contact customer service.
The operator reserves the right to refuse or cancel the creation of an account or access to the service to any user who does not meet the conditions required in these GCUS.
4.1.2. Via a CB totem
In order to be able to use the service, the user:
- must choose their Pass on the home screen;
- defines the number of bikes they want to use with their Pass ;
- accepts these Terms;
- pre-authorizes payment corresponding to the amount of the deposit, defined according tothe number of bicycles chosen;
- recuperation of his RFID ticket printed by the terminal.
The user is limited to the number of bikes chosen from his offer in simultaneous race.
The user is solely responsible for his RFID ticket. In case of loss or forgetfulness, the user must contact the customer service.
4.2. Terms of borrowing the Bike in Station
4.2.1. With the app
When renting a Bicycle, the user must:
- Open the iOS or Android app on your smartphone
- (Required) Enable geolocation and Bluetooth if you haven't already done so
- (Optional) Enter your destination address to be guided to the departure and arrival stations closest to your itinerary
- (Optional) The user has the possibility to book a bike in the station for a few minutes
- Go to the first available bike on the row of bikes parked against a charging station
- Scan the QR code or manually enter the bike ID number
- Press the left brake to release the bike
- The unlock is confirmed by an audible signal (double beep), a notification in the app and the rental begins.
The unlocking of the bike is done via communication between the bike and the smartphone.
4.2.2. With a transport card or RFID ticket
In the case of the use of the transport card only, and before the1st rental of a wish, the user must link his transport card number to his compte in the application or on the Internet site.
When renting, the user must:
- Go to the first available bike on the row of bikes parked against a charging station
- Press the left brake to operate the RFID reader
- Place the transport card or RFID t icket on the frame sign
- Wait green LED + double BIP + lighting of the lights that confirms the start of the journey
- Press the left brake again to release the bike
- The unlocking is confirmed by an audible signal (double beep) and the rental begins.
4.3. Arrangements for borrowing a levélo in a virtual station
4.3.1. With the app
When renting avo elo in a virtual station, the user must:
- Open the iOS or Android app on your smartphone
- (Required) Enable geolocation and Bluetooth if you haven't already done so
- (Optional) Enter your destination address to be guided to the departure and arrival stations closest to your itinerary
- (Optional) The user has the possibility to reserve a bike in a virtual station for a few minutes
- Go to one of the available bikes indicated in the application
- Scan the QR code or manually enter the bike ID number
- An audible signal (double beep) indicates that the voelo has been unlocked. The LED of the bike flashes green, the headlights come on, the user receives a notification in the application and the rental begins.
The unlocking of the bike is done via communication between the bike and the smartphone.
4.3.2. With a transport card or RFID ticket
When renting a Bicycle, the user:
- Press the left brake of the bike of the virtual station
- Pass your transport card or RFID ticket on the frame logo
- An audible signal (double beep) indicates that the voelo has been unlocked. The bike LED flashes green, the headlights light up and the rental begins.
4.4. Case of a defective bicycle preventing the taking of a functional Levélo
If the first bike in the row is unavailable (defective or without battery) then when attempting to start the trip:
- The bike flashes red and beeps "error".
- If the user uses their application, a specific screen appears and tells the user:
- that the first bike is unavailable and the reason
- that it must be deposited on the maintenance terminal to access the next one
If the user uses his transport card or an RFID ticket, he contacts the customer service.
- After validation of the user in the application or directly after the RFID scan if necessary, the bike unlocks for a period of 2 minutes. It emits a specific beep, different from the beep emitted at the beginning of a journey so as not to confuse them, the lights remain off and the assistance is cut.
- The user presses the left brake to release the bike and leads it to the roll bar (if the user uses the application, a specific screen to accompany it appears).
- The bike locks automatically once attached to the maintenance hoop. This trip will not be charged to the user.
- The user can then access the next bike
4.5. Secure a levélo outside a Station during the rental
It is possible to lock the voelo during rental. The user is informed that in this case, the rental time continues to be counted.
4.5.1. With the app
To lock his wishoutside of a set, the user presses the "Pause" button. An audible signal (double beep) indicates that the levélo has been locked. The app enters pause mode. The bike's LED flashes pink and the headlights turn off.
To unlock the velo and resume its journey, the user clicks on the "Resume my journey" box. An audible signal (double beep) indicates that the Bike has been unlocked. The bike's LED flashes green and the headlights light up.
4.5.2. With a transport card or RFID ticket
To lock levélo outside a station, the user:
- Press the left brake
- Pass your transport card or RFID ticket on the frame logo
- An audible signal (double beep) indicates that the Bike has been locked. The bike's LED flashes pink and the headlights turn off.
To unlock levélo and resume its journey, the user:
- Press the left brake
- Pass your transport card or RFID ticket on the frame logo
- An audible signal (double beep) indicates that the Bike has been unlocked. The bike's LED flashes green and the headlights light up.
4.6. Terms of return of the levélo at the end of the rental
4.6.1. Return of a bicycle in station
In the case of using the application with destination informed, the user is accompanied to the nearest available station to his destination by following the route and indications indicated by the application. The user (if he enters his destination) can change his destination in the application at any time.
Once in front of the seat, the user must attach his wishdirectly to the sting or the voelo already present on the sting thanks to the two magnets located on the top of the frame below the fork and on the bottom of the frame at the rear hub, and to the guide strip by positioning the front wheel in the notch.
If the bike has been hung up, the user sees a double green flashing on the bike frame and hears an audible signal (double beep). In addition, the headlights of the bike go out. The rental then ends automatically. A voelo is considered returned only when it is locked in station.
In the case of using the application, the summary of the trip with the invoiced price appears on the screen and gives the user the possibility to rate his trip.
An error message will warn the user if his wishelo is rendered incorrectly. In this case, he is invited to repeat the procedure of deposit of the voelo on the station.
If after the beep the user still fails to complete his trip, he must contact customer service as soon as possible.
The user can access the history of his trips on his profile on the application or website.
4.6.2. Return of a bicycle in virtual storage
The user deposits his wish in the v irtuelle s indicated on the application.
4.6.2.1. With the app
To finish his trip in a virtual station, the user presses the button "End my trip". An audible signal (double beep) indicates that the Bike has been locked. The bike's LED flashes pink and the headlights turn off. The journey is over.
4.6.2.2. With a transport card or RFID ticket
To complete his journey in a virtual facility, the user:
- Press the left brake
- Pass your transport card or RFID ticket on the frame logo
- An audible signal (double beep) indicates that the levélo has been locked. The bike's LED flashes pink and the headlights turn off.
- The journey is over.
4.6.3. Return of a defective bicycle
If a defect affecting the use of the deviceby a user appearsduring the rental, then the user can declare it in the application. He is then invited to return his bike directly to a maintenance roll bar if he judges that the bike is no longer usable, in order to isolate it from other bikes.
This can also be done by contacting customer service.
4.6.4. Emergency end-of-trip request
In the event of a problem encountered in completing his journey, the user contacts the customer service.
Outside the opening hours of customer service, the user has the possibility to request the end of his journey in the application. He is invited to click on the button "REQUEST THE END OF MY TRIP" and to fill out the request form. He must confirm that he accepts and respects the conditions of end of emergency journey listed in the article of the form to validate his request.
Once the form is completed, and the photo of the bike transmitted, the customer service will come back to the user and proceed to the regularization of his trip. In case of misuse of this feature, the operator reserves the right to charge penalties of the amount applicable to the disappearance of the bike without justification from the beginning of the rental listed in Article 9 of these GCUS.
Article 5 - RATES AND METHODS OF PAYMENT
The applicable rates are specified on the website and the application and are displayed at the time of subscription of the service by the user.
5.1. Cost of the service
The cost of levélo includes:
- the cost of access to the service subscribed by the user, which varies according to the type of subscribed or Pass subscribed
- the cost of use, which varies according to the type of subscription or Pass subscribed and the duration of use of the service
Each trip can be consulted in the "My Account" section available on the website and the application.

The tariff is charged to the user directly on his credit card according to the duration of the journey. Every minute started is due.
The user acknowledges and accepts that the applicable ratesmay increase. This principle applies in the event of a revision of tariffs. The user will be notified on all the media of the service in case of revision of the tariffs.
In the event of a change in the cost of use, this change will automatically apply to current subscriptions.
In case of change in the cost of access, the user will have a period of 15 days from the notification of the new rates to cancel his subscription. Otherwise, the new pricing will be applied at the next deadline.
5.2. Gratification
In case of reporting of a bike deemed unusable and removal on a maintenance hoop, the user is rewarded with bonus points after removal to the maintenance hoop. An automatic e-mail is generated to notify him and the point counteris dynamically updated in the application and the website.
The user will also be rewarded with bonus points depending on the frequency and quality of his use of the service.
These bonus points can be converted into free minutes and other benefits on the service.
5.3. Payment for the Service
Invoicing for the service is made on the basis of thejourneys actually made, with invoicing for each journey.
The billing of the subscription is done on the anniversary date of subscription of the subscription, in full month.
For security reasons, some types of credit cards may be temporarily or permanently unusable on the service.
5.3.1. Through the use of its compte (application, transport card)
The payment of the service is made by credit card whose data the user will have filled in when creating his accountor as part of any update of his banking information.
By entering his credit card numbers, the user grants the operator an authorization to debit credit card for all amounts due by the user in accordance with these GCUS. The user acknowledges and declares:
- That the credit card associated with hisaccount and his contact details are and remain valid;
- That he has the capacity, consent or authority required to associate this bank card with his compte and to be charged to this card for the use of the service.
At the beginning of the journey, Stripe Inc (the payment platform chosen by the operator) pre-authorizes the debit of the user's credit card in order to guarantee payment for the service.
In some cases depending on the user's bank, this pre-authorization may temporarily appear on the user's bank account; said pre-authorization is deleted at the end of the trip to make room for the final debit.
5.3.2. Through the purchase of a short-term subscription on a Totem CB
Payment of theservice is made by credit card whose data the user will have filled in when purchasing the short-term subscription on the CB subscription.
By entering his credit card numbers, the user grants the operator an authorization to debit credit card for all amounts due by the user in accordance with these GCUS. The user acknowledges and declares:
- That the credit card associated with hisaccount and his contact details are and remain valid;
- That he has the capacity, consent or authority required to associate this bank card with his cardand to be charged to this card for the fees for using the Service.
When purchasing the subscription, Nepting (the payment platform of the CB chosenby the operator) pre-authorizes the debit of the user's credit card in order to guarantee payment for the service.
In some cases, depending on the user's bank, this pre-authorization may temporarily appear on the user's bank account; said pre-authorization is deleted at the end of the validity of the subscription to make room for the final debit.
5.4. SECURE payments
The operator uses the services of Stripe Inc and Nepting, specialized companies to secure online payments made by credit card. Payments are made via a secure and PCI-DSS certified payment interface. These companies undertake to maintain this certification (or any equivalent certification, whatever its future name) and is responsible for the security of the data of the credit card holders that they collect or store, process or transmit in the name and on behalf of the operator. The user is informed that the provisions relating to the possible fraudulent use of his credit card are those resulting from the Pass ee agreement with his bank. The operator can in no way be held responsible in case of fraudulent use of the means of payment of a user.
5.5. Modification and termination of the Subscription by the user
The user has the possibility to modify and terminate his subscription on the application or the Internet session.
The permanent subscription cannot be modified or terminated during the first 12 months, except in the case of a modification or termination for legitimate reasons: death, loss of employment, change of professional domicile outside the territorial jurisdiction, long-term hospitalization.
Beyond the first 12 months, the cancellation request must be made at least 10 days before the anniversary date of the subscription.
In case of change in the cost of access, the user will have a period of 15 days from the notification of the new rates to cancel his subscription. Otherwise, the new pricing will be applied at the next deadline.
5.6. TERMINATION for fault of the user
The subscription will be terminated by the operator in case of fault of the user under the following conditions. In particular, the following are considered as a fault of the user:
- Failure to pay in part or in part the price of a trip or any amount due for the service.
- Use of the service that does not comply with these Terms.
If, after formal notice to the user to remedy the unsuccessful breach, the operator suspends access to the service until the situation is rectified by the user.
During the suspension of access to theservice, the user nevertheless remains liable for the journeys previously made.
If the service is suspended for more than two (2) months, the operator may terminate the Contract.
Article 6 - OBLIGATIONS OF THE USER
The user undertakes to make normal and private use of the service. As such, the user undertakes to use the service in a prudent, diligent and informed manner, and in compliance with these GCUS and the Highway Code and any applicable regulations.
The user assumes custody of the voelo he has rented. It is responsible for its possible degradation, destruction or disappearance. He will have to systematically lock the voelo with the pause feature as soon as he stops out of station and leaves the bike out of his supervision. The user undertakes to rent and return the wishwithin the time limits of the Authorized Continuous Use Period.
The user accepts in advance that any breach of these obligations will entitle the operator to the payment of a fixed penalty, the final amount of which is fixed according to the terms and conditions provided for in Article 9. In the event of the use of a wish contrary to the provisions of these GCUS, the user undertakes to return the wish at any time, at the first request of the operator or its representatives.
The user undertakes to report as soon as possible to the customer service the loss or theft of the wish, or any other problem relating to the wish, to the use of his access code, and at most within 24 hours of the occurrence of the event, the voremaining in any case under his responsibility until its return. Users are solelyresponsible for updating their personal details and for the harmful consequences that could result from failure to communicate any related changes. In order to be able to maintain access to the service, the user undertakes to maintain a valid bank card for the duration of the use of the service. If necessary, he updates the contact information and the validity date of his card directly on his Account.
Article 7 - RESTRICTIONS ON USE OF THE SERVICE
Access to the service is prohibited to minors under 14 years of age, accompanied or unaccompanied.
The service is accessible to minors between the ages of 14 and 18; the legal guardian may choose to pay for the use of the minor by registering his/her personal payment card on the minor's account.
The legal guardian of any minor using the servicewill be held liable for any damage caused directly or indirectly by the minor as a result of the use of the service.
As with any subscription holder, minors over the age of 14 must have a personal account, phone number and email address. It is specified that the accounts are strictly personal, and allow the user to rent, use, and return a wishat any time according to the conditions described below.
It is therefore forbidden for the user to lend, rent or assign his Account.
The user is authorized to use the vélo according to the terms hereof, which excludes in particular:
- any use contrary to the provisions of the applicable road regulations, in particular the provisions of the Highway Code;
- any use on land or in conditions likely to damage levélo;
- the carriage of any Passenger in any way;
- transport in the front basket of a load greater than 5 kg;
- any use of the voélo that may endanger the user or third parties;
- any dismantling or attempted dismantling of all or part of the levélo;
- More generally, any abnormal use of avo.
The levélo cannot support a total load greater than 120kg. The operator reserves the right to suspend access to the user's account automatically and without compensation if it turns out that the user does not comply with the conditions provided for in this article, and in particular in the event of theft, vandalism, endangerment of others.
Article 8 - RESPONSIBILITY ANDDECLARATIONS OF THE USER
The user declares to be able to use a voelo and to have the physical condition adapted to this use (sufficient size, good health, etc, ...).
As the wish is placed under the responsibility of the user, it is recommended that he proceed, prior to the actual use of the removed Bicycle, to an elementary verification of its main apparent functional elements, and in particular (non-exhaustive list):
- the proper attachment of the saddle, pedals and basket;
- the proper functioning of the doorbell, brakes and lighting;
- the general good condition of the frame and tyres.
Otherwise, the user must report any incident via his Account on the application and / or to customer service. He will then be able to borrow a second bike after depositing the disputed bike on the maintenance rack provided for this purpose.
The user declares to have taken out and hold a civil liability insurance in force that guarantees the consequences of the use of the voo. It is also recommended that the user:
- adapt its braking distance in the event of bad weather;
- adjust the saddle to adapt its height to its morphology;
- wear an approved helmet and appropriate clothing.
If he wishes, the user can use the smartphone holder available on the handlebars and apply it to be guided on his way. The user is responsible for damage caused to his smartphone in case of fall or misuse of the support. If the media is visibly defective, the user is obliged not to use it.
The user is solely and entirely responsible for damages caused by the use made of the voduring the entire Term of Use, including when it exceeds the Authorized Continuous Use Period in case of late return by the user. The parents or legal guardians of any minor registered for the service will be held liable for any damage caused directly or indirectly by the minor as a result of the use of the service.
Any loan exceeding 24 hours is considered as a case of disappearance of the wish without justification until it is found, and this may give rise to penalties under the conditions defined in Article 9.
If the disappearance of the wishelo is the responsibility of the user, he has the obligation to report this disappearance to customer service within 24 hours of the initial loan, and this may give rise to penalties under the conditions defined in Article 9.
If the disappearance of the vo elo is not the responsibility of the user, he has the obligation to report this disappearance to customer service within 24 hours of the initial loan and to file within 48 hours with the police a complaint for theft of the vo elo and to communicate to customer service a copy of the complaint.
In the event of an accident and/or incident involving the wish, the user has the obligation to report the facts as soon as possible to the customer service. The voremains under his responsibility, either until it is locked or, failing that, until confirmation of a remote locking request to customer service.
Article 9 - PENALTIES
For each purchase of ticket, a pre-authorization to debit the user's credit card in order to guarantee the proper use of the service will be made for an amount of € 300. In some cases, depending on the user's bank, this pre-authorization may temporarily appear on the user's bank account; said pre-authorization is deleted at the end of the trip to make room for the final debit.
In the case of the purchase of a ticket in totem CB, the user has the possibility to use several bicycles with his Pass, paying each time the amount of the Pass. In this case, a degressivity of the pre-authorization is applied:
- 1 bike : 300 €
- 2 bikes: 480 €
- 3 bikes: 540 €
- 4 bikes : 600 €
The user undertakes to comply with these general conditions of access and use of the service and to return the borrowed wish in the same condition as at the start of the rental. The user authorizes the operator in advance to request the following penalties in the event of failure to comply under the conditions defined below:
- Theft of the bike with proof of complaint filed : 150 €
- No return or disappearance of the bike without justification fromthe beginning of the rental: 300 €
- Damage suffered by the bike and attributable to the user: lump sum of 100 € per levélo in addition to the purchase cost of spare parts that will have to be replaced.
Article 10 - PERSONAL DATA
The user's personal data will be processed in accordance with the operator's privacy policy.
Article 11 - DISPUTE RESOLUTION
The GCUS and the relations between the user and the operator are subject to French law. In the event of a complaint, the user may contact the customer service either by using the form provided for this purpose on the Site, or by email to the address: levelo@ampmetropole.fr or by mail to the postal address Customer Service LEVÉLO - 10 boulevard Ampère - 13014 MARSEILLE. The user has a period of one month from the disputed event to proceed with this step.
The Parties shall make their best efforts to find an amicable solution to any dispute arising between them.
In accordance with Article L. 612-1 of the Consumer Code, the operator guarantees the user the possibility of resorting, in the event of a complaint having given rise to a prior written complaint to customer service, to a conventional mediation procedure or any other alternative dispute resolution method.
Failing to reach an amicable resolution, any dispute relating to the interpretation, execution or breach of these GCUS and/or the relations between the user and the operator will be the responsibility of the competent French courts, notwithstanding the plurality of defendants and/or warranty claims, even for emergency procedures or interim or request proceedings.
Article 12 - APPLICATION AND ENFORCEABILITY OF THE GTCU
These GCUS apply to any use of the Service by a User and are available at any time at the https://levelo.ampmetropole.fr address.
The user undertakes to read the GCUS and to accept them before the first use of the service and the download of the application. The user is informed that the mere fact of using the service implies full acceptance without reservation of all the stipulations provided for in these GCUS. He acknowledges being fully informed of the fact that his agreement concerning the content of the GCUS does not require the handwritten or electronic signature of a document. The operator reserves the right to modify the GCUS at any time, without notice, it being understood that such modifications will only apply to subscriptions and uses madeafter these modifications. The fact that the operator does not avail itself, at a given time, of one of the provisions of these GCUS, can not be interpreted as a waiver of the right to avail itself of it later.
In the event that one of the clauses of the GCUS is declared null, illegal or unenforceable, in whole or in part, the other clauses will remain in force and continue to have full effect. In the event that the serviceis entrusted to a company other than the operator, the user accepts that these GCUS are automatically transferred to the assignee, whoever it may be.
